The doctor, who is registered with the HPCSA and is only registered to work in the Public Service has been banned from working in any capacity other than General Practitioner – Public Service.
The HPCSA received various complaints against Dr Mahfouz ranging from practising as a locum at a private clinic, to practising outside his scope of practice, dispensing medicine without a license, not keeping proper clinical records and issuing fraudulent medical certificates.
Council approached the High Court
The Council conducted an investigation and approached the High Court for an interdict.
Given the fact that Dr Mahfouz has been dismissed from the Public Service and therefore cannot practise as General Practitioner – Public Service, the practical effect is that he may not practise medicine in South Africa.
“The Medical and Dental Professions Board of the HPCSA did not take the decision to prohibit a practitioner from practising his profession lightly, but as we have a mandate of protecting the public and guiding the professions, the Council had specific reasons why he was registered to only work at public hospitals and clinics and not being allowed to have his own practice,” HPCSA Registrar and CEO, Dr Buyiswa Mjamba-Matshoba said.
Dr Mahfouz has also been ordered by the Court to pay the costs of the application.
