smoking near 11month old

My hubby insists on carry our 11 month old when he smokes. On many occasions he puts the unlit cigarrete in his mouth. Our son now cries to go by dad whenever he smokes. We fight everytime he does that but his excuse is that his grandfather did that with his father, his father did that with him, he will do that with his son.
I am only too afraid of the consequences. I am thinking of a divorce for other reasons as well, and when I pick on this, he claims that he is doing nothing wrong and he will still get custody.
I do not know what to do.

You know the answer to your question. It is obviously wrong and totally irresponsible for your husband to smoke while carryng his son around. He will be surprised to find that he will not get custody as this behaviour is regarded as being completely unacceptable these days.
