Termination of temp contract after 5 years.

Hi

I have been employed as a temp in a dept for 5 years . Last week friday we got a letter not from the agencie but the dept that our contracts end 1feb 2010. We only signed one contract when we started for 3 mnths and never signed another one. Do we have a right to take them to ccma. They say it is due to financial constrants that they have to let us go. What if any rights do we have as temps.

You are not employed as a temp, in fact you are employed on a permanent basis. You have a right to take them to the CCMA. If they had to let you go for financial constraints then it was a retrenchment. It looks like they haven't done the proper thing, it is suggested that you do refer the matter to the CCMA for an unfair dismissal for operational requirements.
