Sick Leave

I had two major surgeries within three months Neck disectomy in July 2009 and total hip replacement in October 2009 with the result I was off work for six weeks and three months respectively. I am told I have depleted my sick leave for the next three years as my operations were at the start of my new cycle. As i was not actually " sick"  is there not a clause which protects me from this
