Salary Bands

Is it legally appropriate to have two employees with the same job title and same job description, and wrote the same board exam to get paid different salaries?

I have been with my company over 6 years and still they don''t'' stick to the same paydate. One month its the 25th, the next its the 28th, the next the 26th - some of my debit orders (a personal loan and my car) come off on the 26th as my employer has several times promised to pay on 25th (which he will stick to for 2-3 months and then its back to whenever he decides) and as a result I get put into overdraft and I don''t have an overdraft facility. I want to charge him fees for the excess and all the transfer fees if I transfer money out my credit card to cover the debit orders.

It depends if the one has been working for longer than the other at the company
