Reading private e mails

Is there any recourse that an employee can take if the employer reads private e mails while one is away on sick leave. It was not an unopened mail, but one that was sent about 1 month before the snooping occured. In other words it was completely unecessary in the line of work.

an employer cannot read your private emails whilst you are on sick leave unless there is a specific electronic surveilance policy within the company
