Information

Hi there

Custody:

In the past the mother would be more likely to get cutody of the child. I am sure that today its equal for both father and mother.
If the parents are fighting for custody who would be more likey to get custody on the following situation:

Father:
Working - (flexible job)
Own Home
Car
Financially responsible (but joint responsibility in court agreement) for child:
School fees
School transport
stationary
medical Aid
clothing
School uniform
Medication (chronic x2) - one for mother''s house
Attends all school meetings and activities.
Concerned about childs health - medication important to be with child at all times ect...

Mother
Responsible for nothing, Financially
Only started attending school meetings resently
does not have vehicle
does not have job
partner pays rent and looks after the mother
Neglects child health
ect.
The " mother"  has the ability to fetch the child and drop the child off when needs to be , they take the child out and spend time together but this is all possible because of the partner he has. This looks as if she is doing it herself, but he would not be able to without the partner.

Who is more likely to get custody??

Both parents will get joint parental rights, with the mother normally the parent of permanent residence and the father the parent of alternate residence. Thus the child will live with you and he will have contact to the child every alternate weekend, holiday etc. This normally when the child is about 4 years old. In the scenario scetched the father would likely get custody. The test is what is in the best interests of the child.
