After being snubbed by the Judicial Service Commission (JSC) four times, Judge David Unterhalter has finally been promoted to the Supreme Court of Appeal (SCA).
The JSC voted to support Unterhalter, Gauteng High Court Judge Raylene Keightley and Eastern Cape High Court Judge John Smith as their chosen candidates for three vacancies at the SCA.
In October, the JSC interviewed 10 candidates for four vacancies at the Supreme Court of Appeal.
At the time, the Judicial Service Commission chose not to fill two of the vacancies and snubbed several potential candidates, including the renowned Unterhalter.
Freedom Under Law said Unterhalter was unfairly disqualified on the basis of unsubstantiated claims of racism and arrogance.
